AZOI LIMITED WARRANTY

Azoi Inc., A Delaware corporation and producer of the Kito+ device (the “Company”) warrants to you, the original retail purchaser or the original online purchaser from the Company (each, a "Consumer"), that the Kito+ device (the "Product") will under use in accordance with the guidelines and documentation provided by the Company on its website at azoi.com and/or with the product (the “Documentation”) operate substantially as described in the Documentation for a period of at least one (1) year (365 days) from the date of original purchase. Consumer's sole and exclusive remedy, and Company’s sole and exclusive responsibility under this limited warranty will be, to replace the defective Product with a new or refurbished Product during the one (1) year limited warranty period in accordance with this limited warranty so that it performs substantially in accordance with the Documentation.

  1. The warranty period for any replacement Product provided pursuant to this limited warranty shall expire one year following the purchase of the original Product.
  2. The foregoing warranty is limited and is not applicable to: (i) normal wear and tear, and cosmetic appearances of the product due to use; (ii) defects or damage caused by misuse, accident (including without limitation collision, fire, natural causes), neglect, abuse, alteration, unusual stress, modification, improper or unauthorized repair, installation, wiring, or testing, improper storage, use in an unapproved manner; (iii) use not in accordance with the Documentation; and (iv) damage caused by the equipment with which the Product is used.
  3. To obtain warranty service on Product purchased through a Company authorized dealer, please follow the instructions provided to you by that authorized dealer.
    1. To obtain warranty service for any Product that was bought directly from the Company, Consumer must contact the Company’s customer/warranty support department though the support form at azoi.com with proof of purchase and the date of purchase of the Product. After the Company has determined to its satisfaction that the Product is eligible under this warranty, Company shall provide a replacement device, including paying for shipping of such replacement device. Company may at its option request the return of the defective Product at the Consumer’s expense.
    2. No Company reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
    3. The limited warranty extends only to Consumer and is not assignable or transferable to any subsequent purchaser or user.

THE LIMITED WARRANTY SET FORTH ABOVE IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES AND COMPANY HEREBY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, NON-INFRINGEMENT, QUALITY AND TITLE. COMPANY DOES NOT WARRANT THAT THE PRODUCT IS ERROR FREE OR THAT IT WILL FUNCTION WITHOUT INTERRUPTION.

IN NO EVENT WILL COMPANY BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUES, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, COST OF ANY REPLACEMENT GOODS OR SUBSTITUTE EQUIPMENT, LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS BEING REPLACED OR REPAIRED, CLAIMS OF ANY THIRD PARTIES, OR ANY OTHER DAMAGES ARISING FROM COMPANY’S BREACH OF THIS LIMITED WARRANTY OR THE USE OF THE PRODUCT, REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL OR EQUITABLE THEORY, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL COMPANY’S TOTAL CUMULATIVE LIABILITY EXCEED THE PRICE PAID BY CONSUMER FOR THE PRODUCT.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. KITO+ 30-DAY RETURN POLICY

If for any reason you are not entirely satisfied with the Product you may return it for any reason within 30 days of purchasing the Product. If you have purchased the Product from a Company authorized dealer, return it to the authorized dealer.

The following return policy covers Products purchased from the Company directly

If you have purchased the Product directly from the Company contact our customer service at through the support form on azoi.com within 30 days of purchase along with adequate proof of purchase to obtain a Return Merchandise Authorization (“RMA”) and get a refund.

To qualify for a refund, the returned Product must be in in its original physical condition (not physically broken, damaged or marred in any way) and you must include the original undamaged and unmarred packaging and accessories. We reserve the right to refuse refunding you for any returned Products that are damaged, marred or have missing accompanying accessories or parts. All returned Products must be accompanied by adequate proof of purchase and any other documentation required under the RMA.

You will be responsible for all return shipping charges and shall assume all risk of loss or damage to the product while in transit to us. We recommend that you use a traceable method of shipping for your protection.

Return shipping instructions and return address will be included in your RMA document provided by us.

The refunds will be processed and paid within 4 weeks following our receipt of the product. The refund doesn’t include shipping charges, gift wrap fees and duties and taxes paid, if any.
